These Terms and Conditions apply to all online booking deposits for new build properties and should be read in conjunction with the UPS Booking Form which will be issued to you following receipt of your deposit. By making a booking and paying the deposit, you confirm that you have read and agree to these Terms.
1. Booking Deposit
1.1 A booking deposit of £1,000 (the “Booking Fee”) is payable to UPS to initiate a reservation.
1.2 Of this amount, £500 is non-refundable.
1.3 Payment of the Booking Fee does not in itself confirm a reservation. A UPS representative will contact you to complete the booking process, issue the Booking Form, and confirm details. The booking is only effective once the Booking Form has been signed by the Purchaser and acknowledged by UPS on behalf of the Seller.
2. Reservation Period
2.1 In consideration for payment of the Booking Fee, together with acknowledgment from UPS and the signed Booking Form, the Seller agrees to reserve the property at the purchase price until the Booking Expiry Date stated in the Booking Form.
2.2 The Purchaser must be in a position to sign an unconditional contract within six weeks of receipt of the draft contract.
2.3 If the Purchaser is unable to proceed within this timeframe, the Seller may place the property back onto the market.
3. Cancellation & Refunds
3.1 If the Purchaser cancels the booking, the Seller will refund the Booking Fee less £500, which is retained as a non-refundable administration charge.
3.2 If the Seller cancels the transaction for reasons other than a Purchaser breach, the Booking Fee will be refunded in full.
3.3 The Booking Fee will be deducted from the total purchase price on completion of the sale.
4. Online Booking Process
4.1 The booking process is as follows:

5. Payment Methods
5.1 Payment of the Booking Fee can be made by credit card or debit card. Cards accepted include Visa and Mastercard.
5.2 Payments in cash or cheque are accepted only at UPS offices. Reservations will not be confirmed until such payments have cleared.
6. Conditions of Reservation
6.1 A deposit of 10% of the purchase price will be payable on formation of the contract.
6.2 Only approximate completion dates can be given until exchange of contracts; a fixed completion date can only be confirmed at that stage.
6.3 The Seller cannot guarantee exact replication of the materials, designs, or finishes shown in viewing homes or marketing literature and reserves the right to change suppliers, materials, or layout as required.
7. Disclaimer Regarding Extras
7.1 Should the sale of the property not proceed (except where due to Seller negligence), any monies paid by the Purchaser for Additional Extras will be non-refundable.
7.2 Additional Extras beyond the standard specification will not delay completion.
8. General
8.1 Nothing verbally implied by UPS or the Seller is guaranteed unless confirmed in writing.
8.2 These Terms have been prepared in accordance with the Consumer Code for Home Builders.
8.3 All Purchaser information will be used solely for progressing the purchase and for customer surveys, in accordance with applicable Data Protection legislation.
8.4 Neither party shall be liable for failure in performance due to Force Majeure events.
9. Purchaser Acknowledgement
This booking deposit, together with the signed Booking Form, represents the full understanding between the Purchaser and Seller. It supersedes any prior verbal or written statements.
